TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACA CARE CONNECT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.

This includes, without limitation, damages for:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any other intangible losses

In no event shall our total liability exceed the greater of $100 or the amount you paid to us in the twelve (12) months preceding the claim.

12. Arbitration Agreement

You and ACA Care Connect agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration, rather than in court, except that either party may seek injunctive relief in court for violations of intellectual property rights.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law:

• No arbitration shall be joined with any other proceeding
• No right or authority exists for disputes to be arbitrated on a class-action basis
• No right or authority exists for disputes to be brought as a private attorney general

If you wish to opt out of this arbitration agreement, you must notify us in writing within 30 days of first accepting these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page.

Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Site.
